Welcome to Echloe ("we," "us," or "our"). By accessing or using echloe.io (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

1. Service Description

Echloe is an AI-powered digital marketing platform that provides generative engine optimization (GEO) audits, AI content generation, multi-channel distribution, and analytics. Some features are available for free; others require a paid subscription.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Account Registration

To access certain features, you must register an account by providing your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use automated systems to scrape or extract data from the Service beyond the intended API
• Submit content that is defamatory, obscene, or infringes on third-party rights

5. Intellectual Property

Content you create using Echloe remains yours. You grant us a limited license to host and display your content as necessary to provide the Service. All Echloe branding, software, and proprietary technology remain our exclusive property.

6. Payment and Billing

Paid plans are billed through Stripe. Prices are listed on our website and may change with 30 days' notice. All fees are non-refundable except as required by law or as explicitly stated in a specific offer.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.

8. Limitation of Liability

To the maximum extent permitted by law, Echloe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

You may close your account at any time. We reserve the right to suspend or terminate your access if you violate these terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.

11. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
